You're forgetting that Kennedy has 40 years experience of dealing with corporations that have captured the top of levels of Our primary agencies in order to serve the bottom lines of those corporations instead of us citizens. Corporations do not have rights, only human people do.
What makes Kennedy so successful is that he sues on the basis of those rights enshrined in the Constitution while corporation lawyers seek ways around those laws by giving agency broad powers to serve corporations.
The Chevron Deference deferred to corporate captured agencies to create and enforce their own rules at the expense of their stated purpose. What I mean by "corporations" is 3 private investment banks: BlackRock, State Street, and Vanguard. They own each other and together they own 88% of the 500 largest corporations. They control all of what we see, read, and hear. What's interesting is they also own private corporations which do not have to publicly disclose anything about their activities.
The DNC is a private corporation owned by BlackRock. Dems in Congress are both federal employees and employees of the DNC. That's how "our" representatives become wealthy and the status quo that keeps corporate capture funding our government agencies. 50% of the FDA's budget comes from pharmaceutical companies who so happen to be the most heavily fined industry. Almost all of the fines are safety-related, meaning the FDA is not regulating the pharmaceutical companies. $122.76 billion in fines since the year 2000.
